The Vienna Convention on the Law of Treaties (VCLT), 1969, defines a treaty as:

 

o ‘an international agreement concluded between states in written form and governed by international law’ (VCLT article 2(a) )♤ According to the VCLT, whether an agreement constitutes a treaty does not depend on its title, but on whether the parties intended the instrument to be governed by international law.o concluded by states or international organizations with treaty-making power;
