It does not have retrospective powers.

It has jurisdiction:

o on the territory State parties and countries that have accepted the jurisdiction

o in other countries if crime are committed by the national’s of the state parties or the

countries that have accepted the jurisdiction,

o in other countries if crimes were referred to by the UNSC, pursuant to a resolution adopted under chapter VII of the UN charter.

ICC does not replace national courts but complements them. As a court of last resort it only prosecutes cases only when the country is either unwilling or unable to prosecute
